NYC Housing Preservation and Development Local Laws
Summary of Local Laws 122, 111, 123, and 127 of 2023:
Local Law 122 of 2023:
- Annual Notice & Records: Starting September 1, 2024, property owners must provide annual notice and investigation records for lead-based paint hazards or turnover violations. Records of XRF testing, required for these violations, must be provided beginning August 2025.
- Dismissal of Violations: Record-keeping violations can be dismissed if the owner submits the required records for three consecutive years and, if incomplete, pays $1,000 per missing year.
Local Law 111 of 2023:
- XRF Testing: By August 2025, owners must conduct XRF testing in common areas, maintain records, and submit them to HPD upon request.
- HPD Inspections: Effective June 2024, HPD inspectors will visually inspect common area paint conditions during complaint-based inspections in dwelling units.
Local Law 123 of 2023:
- Lead-Based Paint Abatement: If a child under six lives in or moves into a unit with presumed lead-based paint (in buildings built before 1960), the owner must abate lead paint hazards by July 2027 or within three years of the child’s residency.
Local Law 127 of 2023:
- Audits & Violations: Starting September 2024, HPD will include turnover requirement violations and data on elevated blood lead levels as criteria for selecting buildings for audit.
